Subpoenas:

A subpoena duces tecum must be so ordered by a judge. All subpoenas for records are to be served at the Suffolk County Police Department Central Records Section located at Police Headquarters. Notice of the subpoena, however, pursuant to NYS CPLR, must be given to the Legal Bureau via fax 631-852-6546 or e-mail SCPD-Subpoena@suffolkcountyny.gov. We would appreciate as much notice as possible so that we may better accommodate all requests. A subpoena duces tecum cannot be used to command both the appearance of the officer and police records. We ask that you prepare two separate subpoenas, an ad testificandum for the officer’s appearance and a duces tecum for the records, as our officers are not the custodian of those records. All personal appearance subpoenas should be served on the individual officer’s current command. The police records will be sent directly to the requesting court. Suffolk County Police Department does not accept service for retired officers.
