Man Arrested for DWI After Crash That Seriously Injured Two People

Suffolk County Police today arrested a man for driving while intoxicated after he was involved in a motor vehicle crash that seriously injured two people in Bay Shore.

Juan Garay was driving a 2019 Nissan Rogue northbound on Hecksher Avenue, between Spur Drive North and Hemlock Drive, when the vehicle struck a parked, unoccupied 2012 Nissan Altima on the east side of the roadway at approximately 12:25 a.m. The Rogue then struck a southbound 2002 Nissan Sentra head-on, pushing it into a parked, unoccupied 2001 Dodge Ram on the west side of the roadway.

The driver of the Sentra, Nayelhi Vargas, 24, of Bay Shore, and her front seat passenger, Melvin Benavides Cabrera, 24, of Bay Shore, were transported to South Shore University Hospital in Bay Shore for treatment of serious injuries. Garay was not injured. The Rogue and the Sentra were impounded for safety checks.

Officers responding to the scene determined that Garay was impaired and placed him under arrest. Third Squad detectives charged Garay, 35, of 11164 42nd Ave., Corona, Queens, with Driving While Intoxicated. He is being held overnight at the Third Precinct and is scheduled to be arraigned at First District Court in Central Islip on September 14.

A criminal charge is an accusation. A defendant is presumed innocent until and unless proven guilty.
